Warranty

LUMINIS warrants that, for a period of five (5) years from the date of shipment to the original CUSTOMER at the original installed location, each product will be free from any defects in material and workmanship which cause the product to fail to operate in accordance with the products’ performance specifications as they exist at the time of shipment.

The painted finish of the product will be considered defective in material or workmanship only if there is substantial deterioration, in the form of blistering, cracking, or peeling. The painted finish is not warranted (i) against fading or chalking, as product(s) may naturally fade or chalk over time due to normal aging (ii) against deterioration caused by coastal conditions, unless the original product has been ordered with Marine Grade finish (iii) if modifications, such as holes, have been made to the original product.

This limited warranty is void if (i) the product is installed improperly or otherwise not in accordance with the LUMINIS installation instructions and guidelines that are shipped with the product or any applicable standards or codes, such as, without limitation, those standards of codes of the National Electrical Code, the Standards for Safety of Underwriters Laboratory, Inc., or the Canadian Standards Association (ii) the product is altered or repaired other than as authorized in writing by LUMINIS, (iii) the product is misused or abused, whether intentionally or not, including without limitation if the product is used at any time in an environment or operating range, or subjected to electrical values, in excess of those specified in the product’s performance specifications (iv) the product is damaged due to Acts of God, (v) the product is used in violation of any applicable standard or code for use, such as, without limitation, those standards or codes of the Standards for Safety of Underwriters Laboratory, Inc., or the Canadian Standards Association (vi) the product is used other than as a stand-alone product (ie integrated into another lighting product), (vii) the product is damaged in transit or handling, or (viii) CUSTOMER fails to fulfill all financial obligations in regards to purchase of the product.

LUMINIS will not be responsible for any failure of the product(s) that results from external causes such as acts of nature; physical damage; exposure to adverse or hazardous chemicals or other substances; exposure to  reactive cleaning agents and /or harsh chemicals; environmental conditions; vandalism; fire; power failure, improper power supply, power surges or dips, and/or excessive switching; induced vibration; animal or insect activity; fault or negligence of purchasers, any end user of the product(s), and/or any third party not engaged by LUMINIS.

Neither polycarbonate, acrylic, nor silicone material used in the product(s) is warranted against yellowing, as yellowing may naturally occur over time due to normal aging.

If the product(s) are used on existing foundations, anchorages, or structures, the end user is solely responsible for the structural integrity of such existing foundations, anchorages, or structures and all consequences arising from their use.

LUMINIS is not liable for any installation of a pole or pole-mounted product(s) that are installed in wind zones that are in excess of the recommended Effective Projection Area (EPA) values on LUMINIS specification sheets.

LUMINIS’ obligation under this limited warranty is limited to, at LUMINIS’ choice of, either repair or replacement of the defective part or parts, or a new replacement product that will provide equal or better performance. LUMINIS’ OBLIGATIONS UNDER THIS LIMITED WARRANTY DO NOT INCLUDE ANY OTHER COSTS OR EXPENSES, SUCH AS, WITHOUT LIMITATION, ANY COSTS OR EXPENSES OF REMOVAL OR REINSTALLATION WHATEVER THE CAUSE OR, HOWEVER, INCURRED OR IMPOSED (FOR EXAMPLE AND WITHOUT LIMITATION, LABOUR COSTS OR EXPENSES, ADMINISTRATIVE COSTS, OR REQUIREMENTS OF LAW OR ANY GOVERNMENTAL AGENCY OR BODY). NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SHALL APPLY BEYOND THE AFOREMENTIONED WARRANTY PERIOD. The foregoing warranty is exclusive of all other statutory, written or oral warranties and no other warranties of any kind, statutory or otherwise, are given or herein expressed.

LIMITATION OF LIABILITY
LUMINIS will not under any circumstances whether as a result of a breach of contract, breach of warranty, tort, strict liability or otherwise be liable for consequential, incidental, special or exemplary damages including but not limited to, loss of profits or revenues, loss of any other goods or associated equipment or damage to any associated equipment, cost of capital, cost of substitute products, facilities or services, downtime cost or claims of the claimant’s CUSTOMERs. LUMINIS liability on any claim of any kind for any loss or damages arising out of, resulting from, or concerning any aspect of this agreement for the product or services furnished hereunder shall not exceed the price of the product which gives rise to the claim, and any and all such liability shall terminate upon the expiration of the warranty period specified above. 

SPECIAL NOTE
Normal wear and tear on the product are not covered by this limited warranty. Exterior or mechanical damage that is not the result of a breach of warranty will not be corrected. No cosmetic repairs will be made.

WARRANTY PROCEDURE
All claims must be submitted to our customer service department. Once claim is reviewed, the CUSTOMER will be advised of LUMINIS’ suggested course of action, which will follow one of the options below:

Option 1 - Replacement part shipped to CUSTOMER
LUMINIS will try to determine which component is defective and CUSTOMER must issue a Purchase Order for the replacement part(s).  Replacement parts will be shipped under standard lead time and via standard ground freight service. The CUSTOMER will assume all freight costs for expedited service. If the replacement part does not resolve the issue, the luminaire must be returned to the LUMINIS factory for inspection and repair (see option 2).

Option 2 – Return of product/component for inspection
CUSTOMER returns all products or components that are authorized for return to LUMINIS. Each component or product must be packaged carefully so as to prevent damages in shipment. To return product to LUMINIS, the following information is required to produce return customs documentation for re-importing into Canada.

  • Box/Pallet dimensions (Length x Width x Height)
  • Box/pallet weight
  • # of boxes / pallets
  • Pick up address
  • Contact name, phone number, and email address

Once this information is provided to your LUMINISCUSTOMER Service Representative, you will be sent shipping label(s) and applicable return customs documents within 48 hours. ALL PACKAGES MUST INCLUDE A COPY OF THE CUSTOMS DOCUMENTS. LUMINIS is not responsible for packages that experience customs delays due to missing documentation.

Once received at LUMINIS, the product will be evaluated. If, upon inspection, LUMINIS determines that the product has breached the terms of its limited warranty, LUMINIS shall repair or replace the product. LUMINIS will execute such repair or replacement at its sole discretion within a time frame determined by LUMINIS based on standard lead times and availability of parts at time of repair. LUMINIS shall be responsible for shipping costs and charges and all taxes only up to the amount of standard non-expedited ground service charges from LUMINIS factory to the CUSTOMER’s original destination. If there are any physical damages due to improper packaging for the returning shipment, LUMINIS will issue a quote to the CUSTOMER to repair or replace the damaged part(s).

If, upon inspection, LUMINIS determines that the product has not breached the terms of its limited warranty, LUMINIS shall inform the CUSTOMER the reason for this determination. If repairs or a replacement is required, LUMINIS will issue a quote to the CUSTOMER to repair or replace the product. If, the CUSTOMER accepts the quoted charges to repair or replace the product, the CUSTOMER shall issue a Purchase Order to LUMINIS. All freight charges shall be at the CUSTOMER’s expense. If the CUSTOMER declines the quoted charges, LUMINIS shall return the product to the CUSTOMER at the CUSTOMER’s expense. If no decision is communicated from the CUSTOMER to LUMINIS within 90 days, LUMINIS reserves the right to dispose of the returned product.

Please note that in the event that the returned component or product is not found to be defective, CUSTOMER may be subject to a labour charge for the evaluation process.

Option 3 – Purchase replacement fixture
A Purchase Order shall be issued at the current price of the luminaire. The replacement order will be produced under standard lead time and shipped via standard ground freight service. The CUSTOMER will assume all freight costs for expedited service.

Once the replacement order is received by the CUSTOMER, the original product shall be returned to LUMINIS, following the steps listed in Option 2. Original product must be returned to LUMINIS within 60 Days of delivery of the replacement order. Otherwise, the CUSTOMER shall be responsible for paying the invoice of the replacement order.

Once received at LUMINIS, the product will be inspected. If, upon inspection, LUMINIS determines that the product has breached the terms of its limited warranty, LUMINIS shall credit the invoice of the replacement order, including freight charges. If, upon inspection, LUMINIS determines that the product has not breached the terms of its limited warranty, the CUSTOMER shall be responsible for paying the invoice of the replacement order as well as associated freight charges.
